2. Scope and Acceptance

These Terms govern all purchases made through THE MANNEKINS. By placing an order, the customer confirms having read and accepted these Terms, together with the Shipping Policy, Refund Policy and Privacy Policy.

3. Products

THE MANNEKINS creates original collectible sculptures representing historical, literary, artistic, philosophical, musical and cultural figures. Product descriptions, dimensions, materials and finishes are provided on each product page.

4. Materials and Natural Variations

Minor differences in color, texture, iridescent reflections, layer lines and surface finish may occur due to the manufacturing process and do not constitute defects where they do not affect conformity.

5. Product Availability

Products are offered subject to availability and production capacity. If a product becomes unavailable after purchase, the customer will be informed and reimbursed.

6. Prices and Taxes

Prices displayed at checkout are those applicable to the order. Shipping costs and applicable taxes are displayed before payment.

7. Ordering Process

Customers may review and correct their order before final confirmation. Completing payment creates an obligation to pay.

8. Order Acceptance

Orders may be refused or cancelled for legitimate reasons including payment failure, fraud suspicion, technical pricing errors or product unavailability.

9. Payment

Payments are processed securely by Shopify Payments and authorised payment providers.

10. Production

Most sculptures are produced after the order is received. Estimated production times are indicated on the product page.

11. Delivery

Deliveries are made to the address provided by the customer. Delivery conditions are described in the Shipping Policy.

12. Delays

Where delivery cannot be completed within the agreed period, the customer benefits from the remedies provided by applicable consumer law.

13. Right of Withdrawal

Consumers generally benefit from a 14-day statutory right of withdrawal, except where a legal exception applies.

14. Returned Products

Returned products should be complete and adequately protected. The customer may only handle the goods to the extent necessary to inspect them.

15. Exceptions

The right of withdrawal does not apply where products are genuinely made to the consumer's specifications or clearly personalised, or where another legal exception applies.

16. Refunds

Approved refunds are processed using the original payment method in accordance with applicable law.

17. Damaged or Incorrect Products

Customers should contact THE MANNEKINS and provide photographs if products arrive damaged or incorrect.

18. Legal Guarantee of Conformity

Consumers benefit from the French legal guarantee of conformity under the French Consumer Code.

19. Hidden Defects

Consumers also benefit from the statutory guarantee against hidden defects under the French Civil Code.

20. Care

Products are intended as decorative collectible objects. Follow the care instructions supplied with the product.

21. Intellectual Property

The sculptural designs, digital three-dimensional models, product photographs, renders, graphics, texts, product descriptions, logo, branding, visual identity and original website content created by THE MANNEKINS.

They may not be copied, reproduced, scanned, cast, digitized, modified, distributed, published, resold as reproductions or commercially exploited without prior written authorization.

References to historical, literary, artistic, philosophical, musical and cultural figures are used solely for descriptive and identification purposes in relation to the original sculptural works offered by THE MANNEKINS.

Purchasing a physical sculpture does not transfer copyright, reproduction rights, commercial exploitation rights or access to its digital model.

22. Prohibited Use

Customers may not copy, scan, reproduce or commercially exploit THE MANNEKINS sculptures or website content without written permission.

23. Personal Data

Personal information is processed according to the Privacy Policy and applicable data protection law.

24. Liability

Nothing in these Terms limits mandatory consumer rights. THE MANNEKINS is not liable for misuse of products or circumstances beyond its reasonable control where permitted by law.

25. Force Majeure

Performance may be suspended due to events beyond reasonable control in accordance with French law.

28. Governing Law

29. Severability
